The Eighth Amendment of the United States Constitution reads:

"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

Given that numerous scientific studies indicate the relative LACK of harm, both directly and indirectly, caused by private, individual consumption of marijuana -- is not the criminalization of this activity an example of cruel and unusual punishment, and therefore unconstitutional?
